สหประชาชาติย้ำ "ไทยใช้ กม.หมิ่นฯรุนแรง-ไม่อาจรับได้"

วันที่ 9 ธันวาคม ที่กรุงเจนีวา ประเทศสวิสเซอร์แลนด์ ราวินา ชามดาสนี (Ravina Shamdasani) โฆษก ของสำนักงานข้าหลวงใหญ่เพื่อสิทธิมนุษยชนแห่งสหประชาชาติ (OHCHR) ออกแถลงการณ์โดยพาดพิง 2 ประเทศ คือประเทศบาห์เรนและไทย ส่วนกรณีประเทศไทยนั้น ทางองค์กรฯมีความเห็นว่าในประเทศไทยนั้นกำลังมีการดำเนินการใช้กฏหมายหมิ่นพระบรมเดชานุภาพอย่างไม่หยุดยั้งและรุนแรงในคำพิพากษาและมีการละเลยถึงเสรีภาพในการแสดงออก (freedom of expression) ซึ่งกรณีดังกล่าวนั้นไม่เป็นไปตามหลักที่ประเทศที่ยอมรับสิทธิมนุษยชนพึงกระทำกัน และเรียกร้องให้ผู้มีอำนาจในประเทศไทยปรับกฏหมายฉบับดังกล่าวให้ดีขึ้น ในขณะเดียวกันขอเตือนไปยังเจ้าหน้าที่ตำรวจและโจทก์อย่าให้เกิดการจับกุมหรือการกักขังผู้ต้องหาในกรณีที่คดีมีความคลุมเครือไม่ชัดเจน รวมถึงไม่ควรจะส่งต่อคดีที่ไม่มีมูลหรือขาดความชัดเจนเข้าไปสู่กระบวนการยุติธรรมของศาล ท่าทีครั้งนี้ถือเป็นการ “เสียงแข็ง” จากนานาประเทศครั้งที่ 3 ในรอบไม่ถึงสัปดาห์หลังจากที่ก่อนหน้านี้ โฆษกกระทรวงต่างประเทศสหรัฐฝ่ายเอเชียตะวันออก แดร์เรจ พาราดิโซ สัปดาห์กดดันเกี่ยวกับกรณีพิพากษา นาย อำพล (สงวนนามสกุล) หรือ “อากง” ต่อคดีการส่ง sms ที่มีข้อความหมิ่นฯและพิพากษาจำคุก 20 ปี ทั้งที่ในคดีมีจุดบกพร่องอยู่หลายจุด และเมื่อวันที่ 8 ธันวาคม สื่อใหญ่อย่าง CNN ยกให้กรณีการพิพากษา “โจ กอร์ดอน” ลูกครึ่งไทย -อเมริกัน ผู้แปลหนังสือต้องห้าม “The King Never Smiles”ถูกจำคุก 2 ปีครึ่ง เป็นข่าว world headline เหนือข่าวระเบิดพลีชีพในอัฟกานิสถาน ส่วนแถลงการณ์ส่วนที่เกี่ยวข้องกับประเทศบาห์เรนนั้นเป็นเรื่องกรณีการสลายการชุมนุมประท้วงภายในประเทศ Acting Spokesperson for the UN High Commissioner for Human Rights: Ravina Shamdasani Location: Geneva Date: 9 December 2011 (1) Bahrain At the request of the Government of Bahrain, the High Commissioner for Human Rights, Navi Pillay, is dispatching a delegation to the country next week, from 13 to 16 December, to discuss how we can support national efforts towards the establishment of an open and democratic society in Bahrain. The four-member delegation will be led by Mr. Bacre Ndiaye, the Director of the Human Rights Council and Special Procedures Division at the UN Human Rights office, and Mr. Frej Fenniche, the Chief of the Middle East and North Africa Section. The delegation looks forward to engaging with the Government, civil society, members of the political opposition and victims of human rights violations in the country. Upon its return, the mission will submit concrete recommendations to the High Commissioner on the way forward. (2) Thailand We are concerned about the ongoing trials and harsh sentencing of people convicted of lèse majesté in Thailand and the chilling effect that this is having on freedom of expression in the country. Such harsh criminal sanctions are neither necessary nor proportionate and violate the country’s international human rights obligations. We urge the Thai authorities to amend the laws on lèse majesté. In the meantime, guidelines should be issued to the police and public prosecutors to stop arresting and charging individuals under these vaguely worded laws. In addition to the disproportionate prison sentences being handed down by the Courts, we are also concerned about the extended periods that accused persons are being held in pre-trial detention.
