กว่า 35 กลุ่มประชาธิปไตยทั้งในและต่างประเทศ ได้รวมตัวกันเป็น “เครือข่ายประชาธิปไตย (คปต.)”- Democracy Networks เพื่อทำกิจกรรมรณรงค์ยกเลิกมาตรา 112 และปล่อยผู้ต้องหาจำนวน 220 คน ที่ต้องโทษกฎหมายหมิ่นฯ ให้ได้รับอิสระเสรีภาพหรือการประกันตัว
เมื่อ วันที่ 3 เมษายนที่ผ่านมา ได้มีการจัดประชุมวิชาการเกี่ยวกับมาตรา 112 และรับฟังความคิดเห็นเพื่อจัดทำแผนปฏิบัติการรณรงค์เพื่อประชาธิปไตย โดยมีผู้แทนจากหลายกลุ่มทั้งในและต่างประเทศเข้าร่วมประชุมฯ ประกอบด้วย
กลุ่ม เสื้อแดงจากจังหวัดสตูล พัทลุง ราชบุรี สิงห์บุรี นครปฐม ปทุมธานี กรุงเทพฯ สมุทรสาคร สมุทรสงคราม สมุทรปราการ ชลบุรี ตราด ลพบุรี นครราชสีมา อุบลราชธานี อุดรธานี นครสวรรค์ พะเยา ลำปาง เชียงราย กลุ่ม 24 มิถุนา แดงสยาม แดงตะวันออก สมัชชาสังคมก้าวหน้า พลังแดงชะอำ พลังหญิง สหายสีแดง ตัวแทนจากสหภาพแรงงาน สหภาพครู ทนายความ กลุ่มศิลปิน พระสงฆ์ สมาพันธ์นิสิตนักศึกษาแห่งประเทศไทย แนวร่วม LA และแดงเสรีชนเยอรมัน เป็นต้น เข้าร่วมประชุม
ในช่วงเช้าของการประชุมฯ เป็นการบรรยายทางวิชาการเกี่ยวกับมาตรา 112 โดย ผศ.ดร. สมศักดิ์ เจียมธีรสกุล และ รศ.ดร.พิชิต ลิขิตกิจสมบูรณ์ ให้ที่ประชุมได้รับความรู้และความเข้าใจกฎหมายมาตรานี้ดียิ่งขึ้น ส่วนในช่วงบ่าย เป็นการระดมความคิดเห็นเพื่อจัดทำแผนปฏิบัติการรณรงค์ ดำเนินรายการโดยคุณสมยศ พฤกษาเกษมสุข ดร.สุนัย จุลพงศธร และนายแพทย์พงษ์ศักดิ์ ภูสิทธิ์สกุล
โดยที่ประชุมฯ มีมติเป็นเอกฉันท์ต่อแนวคิดในการยกเลิกมาตรา 112 และร่วมกันเสนอกิจกรรมที่จะนำไปสู่การยกเลิกกฎหมายมาตราดังกล่าว เช่น-การตั้งเวทีปราศรัยและเดินรณรงค์ให้ยกเลิกมาตรา112 ในวันสำคัญๆ
-การ ให้ความรู้เกี่ยวกับมาตรา 112 กับสังคมในวงกว้างในรูปแบบต่างๆ เช่น บทความ แผ่นพับ ซีดี และโปสเตอร์ การทำซุ้มตั้งโต๊ะ/จัดนิทรรศการ
-ให้ประชาชนลงชื่อหรือแสดงความคิดเห็นต่อการยกเลิกมาตรา 112
-การทำหนังสือถึงนักการเมืองพรรคต่างๆ และหน่วยงานภาครัฐ ให้รับทราบ
-ตลอดจนให้ความรู้กับคนในครอบครัวของตนเองและรอบข้างให้มีความเข้าใจที่ถูกต้องเกี่ยวกับมาตรา 112
เพื่อ สร้างเครือข่ายรณรงค์ยกเลิกมาตรา 112ให้ครบทุกจังหวัด โดยแต่ละกลุ่มจะดำเนินการทำกิจกรรมที่เสนอมาข้างต้นไปพร้อมๆ กับการรณรงค์ให้ประชาชนร่วมเข้าชื่อขั้นต่ำ 10,000 ชื่อ (ที่กำหนดไว้ในรัฐธรรมนูญ) เพื่อยกเลิกมาตรา 112 ผ่านทางรัฐสภา
ประเด็น ที่สองที่หารือในที่ประชุมฯ คือการรณรงค์ให้อาจารย์สุรชัย ด่านวัฒนานุสรณ์ ได้รับการประกันตัว หลังจากต้องโทษมาตรา 112 และถูกจองจำอยู่จนถึงปัจจุบัน โดยภรรยาอาจารย์สุรชัย ได้เล่าให้ที่ประชุมฯ รับทราบว่า ถึงแม้อาจารย์สุรชัยจะยังมีกำลังใจดี แต่สุขภาพไม่ค่อยดีนัก เนื่องจากอายุมาก ทั้งนี้ เคยยื่นขอความเป็นธรรมเพื่อให้ได้รับการประกันตัว แต่ถูกยกคำร้อง ล่าสุดอาจารย์สุรชัยจึงเขียนพินัยกรรมฝากตนไว้ กรณีถ้าต้องเสียชีวิตในคุก
ที่ประชุมฯ มีมติว่า ควรร่วมกันเขียนจดหมายถึงอาจารย์สุรชัย ซึ่งกลุ่มแดงสยามกำลังดำเนินการอยู่ในปัจจุบัน มีการตั้งโต๊ะในสถานที่ต่างๆ และที่ชุมนุม เพื่อให้ผู้คนได้ลงชื่อเยี่ยมอาจารย์สุรชัย เขียนจดหมายร้องทุกข์ถึงองค์กรด้านสิทธิมนุษยชนในต่างประเทศ ให้ช่วยเหลืออาจารย์สุรชัย และนักโทษมาตรา 112 (ซึ่งปัจจุบันมีทั้งหมด 220 คน ในประเทศไทย) ให้ได้รับอิสรภาพหรือการประกันตัว
โดย คณะทำงานเครือข่ายฯ ซึ่งประกอบด้วยผู้แทนจากกลุ่มต่างๆ ข้างต้น และที่จะเข้าร่วมด้วยในอนาคต จะประชุมหารือในรายละเอียดเกี่ยวกับการทำกิจกรรมต่างๆ ที่เสนอในที่ประชุมฯ ตลอดจนการจัดตั้งเวทีปราศรัยรณรงค์ให้ยกเลิกมาตรา 112 และปล่อยนักโทษกฎหมายหมิ่นฯ ที่คาดว่าจะสามารถดำเนินการได้ในวันที่ 19 พฤษภาคม ซึ่งเป็นหนึ่งในวันครบรอบการต่อสู้ครั้งสำคัญของคนเสื้อแดง
Democracy Networks Establishment with Activities
to Cancel Article 112 and free 220 Thai prisoners with lèse majestè charges
About 35 democratic groups in Thailand and abroad aggregated to set up Democracy Networks (DNs) to launch campaigns and activities for canceling Article 112 and freeing the current 220 Thai prisoners who have been charged under the lèse majestè law. A seminar and operational plan meeting was organized on April 3, 2011 for exchanging knowledge and information about Article 112 and brainstorming to prepare an action plan.
The meeting received considerable interest from representatives of the red shirts in many provinces across Thailand (e.g., Satun, Patthalung, Ratchaburi, Singburi, Nakhon Pathom, Pathumthani, Bangkok, Samutsakorn, Samutsongkhram, Samutprakan, Chonburi, Trat, Lopburi, Nakhonratchasima, Ubonratchathani, Udonthani, Nakhonsawan, Phayao, Lampang, Chiangrai) and various groups (e.g., the 24 Mituna Prachatippatai, Red Siam, Eastern Red, Social Moves, Cha-am Red Power, Palung Ying, Red Comrade, the representatives from labor union, lawyers, teachers, artists, monks, Student Confederation of Thailand, LA Ally, and Red Liberal German).
In the morning session, two invited speakers, Assistant Professor Dr. Somsak Jeamteerasakul and Associate Professor Dr. Pichit Likitkijsomboon, gave talks to the participants about Article 112 (the details cannot be described here). The afternoon session was moderated by Mr. Somyot Pruksakasemsuk, Dr. Sunai Julapongsathorn, and Dr.Pongsak Phusitsakul.
The participants exchanged views and expressed their opinions toward Article 112 and reached strong agreement to conduct several activities in parallel with heavy campaigns to cancel Article 112. As parts of the action plan, the DNs will provide more information to people in Thai society to have the right perception and understanding of Article 112, and its severe enforcement and use of punishment as an efficient tool of the dictatorship. The Article 112 information will be prepared and distributed to the public in the forms of seminars, stage speeches, street-rally campaigns, published articles in various media, such as CD-ROM, leaflets, posters, brochures, etc. One of the legitimacy activities is to expand the anti-112 networks to local areas across Thailand to seek more allies to cooperate and jointly sign the petition for canceling this article.
According to law code in the Thai Constitution, people can submit a petition with at least 10,000 signatures for a specific purpose/demand through the parliament system for consideration.
The second topic discussing in the afternoon meeting was to help Surachai Danwattananusorn (the Red Siam leader) and the current 220 prisoners who have been charged under the lèse majestè law. Surachai’s wife told the participants in the meeting that her husband has a good memtal condition, but his physical condition is not very good because of his age and the environment in the cell.
Surachai’s latest petition asking for bail was rejected, and now he feels that he might not be released, or he might be die in jail. His wife said that her husband wrote a testament and gave it to her in case he should die in prison. The DNs seriously discussed about what the networks can do to help Surachai and other prisoners facing similar charges.
In conclusion, three activities will be conducted, including 1) writing to the international human rights organizations and asking for help to free all Thai prisoners who are charged with lèse majestè; 2) writing to Surachai to give him encouragement and providing information about Article 112; and 3) setting up the tables with a book for people to write and express their condolences to Surachai at Red Shirt demonstrations and other possible areas.
For the coming historic day of the Red Shirts on May 19 this year, the DNs are planning to organize stage speeches about Article 112 and run campaigns to free the prisoners who are charged with lèse majestè. The action plans will be discussed in detail among the representatives from all groups under the networks.
